OFFICIAL RULES & REGULATIONS

 

NO PURCHASE NECESSARY TO ENTER OR WIN. A PURCHASE WILL NOT INCREASE YOUR CHANCE OF WINNING. VOID WHERE PROHIBITED.

1. SPONSOR

The Sweepstakes is administered and sponsored by Perimeter Institute (“Perimeter”) or (“Sponsor”), 31 Caroline Street North, Waterloo, Ontario, Canada, N2L 2Y5

2. AGREEMENT TO OFFICIAL RULES

By entering, Entrants (as defined below) agree to be bound by the following general conditions (“Official Rules”) and decisions of Sponsor, which are final and binding in all matters relating to the Sweepstakes. Winning the prize is contingent upon fulfilling all requirements set forth herein.

3. HOW TO ENTER

a. Sweepstakes begins at 12:00:00 p.m. Eastern Time (“ET”) September 23, 2019 and ends at 23:59:59 ET on November 17, 2019 (the “Sweepstakes Period”). Sponsor’s servers are the official time-keeping device for the Sweepstakes.

b. Follow the links and instructions to enter and submit your first name and last name, age, country, postal/zip code, and a valid email address in the online entry form.

One (1) entry per person (“Entrant”) during the Sweepstakes Period.

Internet entries will be deemed made by the authorized account holder of the email address submitted at the time of entry. The authorized account holder is the natural person who is assigned to the email address by an internet access provider, online service provider or other organization that is responsible by assigning email address or the domain associated with the submitted email address. Multiple participants are not permitted to share the same email address. All entries submitted become the sole property of Perimeter and will not be acknowledged or returned. Use of any device to automate entry is prohibited. Proof of submission of an entry shall not be deemed proof of receipt by Perimeter. Perimeter is not responsible for entries not received due to difficulty accessing the internet, service outage or delays, computer difficulties or other technological glitches.

4. PRIZE

a. One (1) grand prize package available to be won (the “grand prize”), consisting of one (1) trip for two (2) people to Geneva, Switzerland (“Destination”) to visit CERN. Perimeter agrees to cover the costs of: two (2) economy flights from a major international airport in Canada or the continental United States of America to Geneva, Switzerland; ground transportation to and from Geneva airport; hotel accommodation for up to (4) nights; and a VIP tour of CERN. WINNER MUST BE AVAILABLE TO TRAVEL BETWEEN JANUARY 25 AND JANUARY 30, 2020. Approximate retail value of prize is: $5,000 CAD (based on sample Toronto departure).

b. Certain travel restrictions may apply. Travel arrangements are made by Perimeter. No prize substitutions, cash equivalent, or transfer of prizes permitted except at the sole discretion of Perimeter. Prize subject to availability and Perimeter reserves the right, at their sole discretion, to award a prize of greater or equal value if the advertised prize is unavailable. If the winner cannot travel on dates specified by Perimeter, the winner may be disqualified and an alternate winner selected. All other costs not specifically stated herein, including, but not limited to, taxes, meals, tips, baggage fees, medical insurance and excursions not related to CERN, are the responsibility of the winner. Taxes are solely the responsibility of the winner. If a selected event is unable to take place as scheduled, for reasons such as cancellation, preemption, postponement or unavailability, or for any reason beyond the control of Perimeter, Perimeter’s sole responsibility to a winner will be to award the remaining available portion of the prize and no substitution will be provided for the unawarded portion of the prize. Guest must be of the age of majority in his/her jurisdiction of residence. Guest and winner must travel on the same itinerary. Sponsor will not be responsible if winner is denied entry onto aircraft or into the Destination. Tickets are subject to terms and conditions as specified by the issuer. Seat locations to be determined by Perimeter. Winner shall conduct himself/herself with due regard to the public conventions and morals. Winner shall not, while a guest of the Sponsor during the trip, commit an offense involving moral turpitude under local laws or ordinances. Winner shall not commit any act that will tend to degrade the Sponsor, bring Sponsor into public hatred, public disrepute, contempt, scorn, or ridicule, or that will tend to shock, insult or offend the community or public morals or decency or prejudice Sponsor. In the event the winner engages in the above or behavior that (as determined by Sponsor in its sole discretion) is obnoxious or threatening, illegal, or that is intended to annoy, abuse, threaten, or harass any other person, the Sponsor reserves the right to terminate the trip early and send the Winner home with no further compensation. Perimeter in its sole discretion may require winner and guest to sign a liability release, agreeing to hold Perimeter, and the officers, shareholders, directors, employees, agents and representatives of each of them harmless against any and all claims or liability arising directly or indirectly from the prize or participation in the Sweepstakes.

5. ELIGIBILITY RESTRICTIONS

a. The Sweepstakes is open to all persons who are 21 years of age or older and who reside in Canada or the continental United States of America or Hawaii. Employees of Perimeter, K2 Communications and each of their corporate parents, subsidiaries, and affiliates, their advertising agencies, participating sponsors/promotional partners, and the members of their immediate families and/or households (“Promotion Entities”) are ineligible to participate or win.

b. Only one (1) winner per household is permitted in any Sweepstakes administered by Perimeter.

c. Entrants are required to provide truthful information and Perimeter will reject and delete any entry that it discovers to be false or fraudulent. Perimeter will disqualify any entry from individuals who do not meet the eligibility requirements, and Perimeter will also delete any entry received from persons under the age of 13 in compliance with the Children’s Online Privacy Protection Act and equivalent in Canada.

g. In the event that a prize or prize certificate is mailed to the winner, winner assumes the risk of its loss. Perimeter is not responsible for the safe arrival of a prize or prize certificate.

6. SELECTED ENTRANT VERIFICATION AND PRIZE CLAIM CONDITIONS

a. Decisions of Perimeter management with respect to the Sweepstakes are final.

b. On November 18, 2019, a random draw will be held from among all eligible entries received during the Sweepstakes Period for the purposes of selecting one (1) potential winner of the grand prize. Odds of winning depend on number of eligible entries received.

Selected entrant will be notified by email provided at the time of entry. In order to be declared an official winner, selected entrant(s) must: (i) respond to notification within 24 hours; (ii) correctly answer, without assistance of any kind, a mathematical skill-testing question which will be administered by email at a mutually convenient time; (iii) sign and return to Sponsor, at its sole discretion, within five (5) business days of it being sent by Sponsor, a written declaration and release form, releasing the Sponsor and the Promotion Entities from any liability in connection with this Sweepstakes or the use, misuse, awarding or possession of any prize (the “Release”); and, (iv) otherwise comply with these Official Rules.

Return of any prize or winner notification as undeliverable, inability to reach selected entrant or failure of selected entrant to respond to Sponsor notification within 24 hours of first attempt by Sponsor or Sponsor’s agent, failure to provide proof of eligibility (if requested), release documents, or other required documentation in a timely manner, failure to correctly answer the skill-testing question, or other non-compliance with these Official Rules may result in disqualification, forfeiture of the prize and, at Sponsor’s sole discretion, selection of an alternate eligible entrant for the forfeited prize in accordance with these Official Rules, who will be subject to disqualification in the same manner.

Any attempt or suspected attempt to submit more than one entry and/or to obtain more additional participations than permitted by using multiple email addresses or a pen name, or any use of robotic, automatic, programmed or other entry methods not authorized by these Official Rules shall be deemed as tampering and will void all of your entries.

7. LIMITATION OF LIABILITY AND RELEASES

BY PARTICIPATING IN THIS SWEEPSTAKES, ENTRANTS AGREE THAT SPONSOR AND THE PROMOTION ENTITIES HAVE NO LIABILITY WHATSOEVER FOR, AND SHALL BE HELD HARMLESS BY ENTRANTS AGAINST, ANY LIABILITY FOR ANY INJURIES, LOSSES OR DAMAGES OF ANY KIND (INCLUDING DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL OR PUNITIVE DAMAGES) TO PERSONS OR PROPERTY RESULTING FROM THE SWEEPSTAKES, INCLUDING THE ACCEPTANCE, POSSESSION, MISUSE OR USE OF THE PRIZE. FURTHER, BY PARTICIPATING IN THIS SWEEPSTAKES, ENTRANTS AGREE THAT SPONSOR AND PROMOTION ENTITIES HAVE NO LIABILITY WHATSOEVER FOR, AND SHALL BE HELD HARMLESS BY ENTRANTS AGAINST, ANY LIABILITY FOR ANY INJURIES, LOSSES OR DAMAGES OF ANY KIND (INCLUDING DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL OR PUNITIVE DAMAGES) TO PERSONS OR PROPERTY RESULTING FROM: A) ENTRY OR PARTICIPATION IN THIS SWEEPSTAKES OR B) ANY CLAIMS BASED ON PERSONALITY OR PRIVACY RIGHTS, DEFAMATION OR PRIZE DELIVERY. Some jurisdictions do not allow the exclusion or limitation of incidental or consequential damages, therefore such exclusions may not apply to you.

8. GENERAL CONDITIONS

a. By participating in the Sweepstakes, winner agrees to have his/her name, voice, or likeness used in any advertising or broadcasting material relating to this Sweepstakes without additional financial or other compensation, and, where legal, to sign a publicity release confirming such consent prior to acceptance of the prize.

b. Perimeter, in its sole discretion, reserves the right to disqualify any person tampering with the entry process, the operation of Perimeter’s website or who is otherwise in violation of the Official Rules. It further reserves the right to cancel, terminate or modify the Sweepstakes if it is not capable of completion as planned, including infection by computer virus, bugs, tampering, unauthorized intervention or technical failures of any sort. Sponsor’s failure to enforce any term of these Official Rules shall not constitute a waiver of that provision. The invalidity or unenforceability of any provision of these Official Rules shall not affect the validity or enforceability of any other provision. If any provision of the Official Rules is determined to be invalid or otherwise unenforceable, then the Official Rules shall be construed in accordance with their terms as if the invalid or unenforceable provision was not contained therein. Should a winner make any false statement(s) in any document referenced above, the winner may be required to promptly return to Sponsor his/her prize, or the cash value thereof. WARNING: ANY ATTEMPT BY AN ENTRANT OR ANY OTHER INDIVIDUAL TO DELIBERATELY DAMAGE ANY WEBSITE ASSOCIATED WITH THIS SWEEPSTAKES OR UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES IS A VIOLATION OF CRIMINAL AND CIVIL LAWS, AND SPONSOR RESERVES THE RIGHT TO PROSECUTE AND SEEK DAMAGES TO THE FULLEST EXTENT PERMITTED BY LAW.

c. Perimeter reserves the right to make changes in the rules of the Sweepstakes, including the substitution of a prize or equivalent value, which will become effective upon announcement. If due to circumstances beyond the control of Perimeter, any competition or prize-related event is delayed, rescheduled, postponed or cancelled, Perimeter reserves the right, but not the obligation, to cancel or modify the Sweepstakes and shall not be required to award a substitute prize.

d. Failure to comply with the Sweepstakes rules may result in entrant’s disqualification solely at the discretion of Perimeter.

e. Perimeter is not responsible for typographical or other errors in the printing, the offering or the administration of the Sweepstakes, or in the announcement of a prize.

f. To obtain a copy of the written Sweepstakes rules and a list of winners (when complete), write to: Perimeter Institute, 31 Caroline Street North, Waterloo, Ontario, Canada, N2L 2Y5. Please include a self-addressed stamped envelope. Winner’s names may be included in a publicly available winners list. At any time you may revoke your consent and exercise your rights of objection, access, rectification, and cancellation by addressing your notice to Marie Strickland, [email protected].

g. Sponsor and its authorized agents will collect, use, and disclose the personal information entrants provide when entering the Sweepstakes for the purposes of administering the Sweepstakes and prize fulfillment.
